FCDL Comment:
DR1:FRN is denied because the applicant is relying on a contract extension; however, the original contract provision for contract extensions stated, “At the end of the initial term, this agreement may be renewed for successive one year terms by written mutual agreement of both parties”. A written mutual agreement to extend the contract until 6/30/2021 was not provided. Therefore, we cannot determine a valid contract was in place at the time the FCC Form 471 was filed. ||DR2:FCC Rules require applicants to retain all documentation for ten years regarding the competitive bidding process. During application review, you were asked to provide all bids associated with this funding request and you were unable to do so. Therefore, this FRN is denied.||MR1:The Contract Award Date was changed from 4/21/2005 to 3/12/2012 to agree with the documentation provided during the review of the FCC Form 471.
