FCDL Comment:
DR1:FCC Rules require applicants to carefully consider all bids submitted by service providers and to choose the most cost effective solution. Documentation provided demonstrates that the applicant did not consider all of the bids that were submitted. Therefore, the applicant has violated the competitive bidding program rules.||DR2:No contract or legally binding agreement was in place when the FCC Form 471 Certification was filed. FCC Rules require that a contract be signed and dated by the applicant or a legally binding agreement is entered into prior to the filing of the FCC Form 471 Certification for the products and services requested. Since this requirement was not met, the FRN is denied.||DR3:During the review of your application, you were asked to provide copies of your competitive bidding documents such as copies of bid response, vendor evaluation score sheet; however, you failed to provide them. Without these documents we are not able to complete your review and must therefore deny your funding request. ||MR1:The monthly quantity for all FRN Line Items was modified from 864 to 1 to agree with the applicant documentation.||MR2:The FRN was modified from $746,496/month to $939.11/month to agree with the applicant documentation.||MR3:On your FCC Form 471, it was indicated the products and services are being provided on a month-to-month arrangement. On 11/28/2016, you provided a contract dated 9/2/2016. Based on this information, USAC has modified the FRN to indicate that these are contractual products and services rather than month-to-month services. This FRN has been changed to reference contract number N/A, Contract Award Date of 9/2/2016 and Contract Expiration Date of 6/30/2021.
