FCDL Comment:
DR1:The FCC Form 470 cited for the FRN states, "The District plans to purchase these services through the Qwest Loyal Advantage agreement as negotiated and signed by the State of Oregon." This description on the cited FCC Form 470 specific to the products and/or services in the FRN contains a particular manufacturer’s name, brand, products and/or service without also specifying “or equivalent”. This is a competitive bidding violation because there is no indication that the FCC Form 470 is also allowing a service provider to submit a bid for equivalent products and/or services. This undermines the competitive bidding process by eliminating the opportunity for the applicant to purchase an equivalent or better product that may be less expensive or to choose a less expensive service provider. Additionally, statements were made indicating “Long Distance services were not selected via a solicitation process.” Thus, you failed to conduct a competitive bidding process for the services requested in the FRN and the FRN is denied.||MR1:The Lines for FRN Line Item 1699044083.001 was modified from 1 line to 304 lines to agree with the applicant documentation.
