The services sought in this FRN include cabling. Under California Procurement Code, the inclusion of cabling in a bid makes the contract a Public Works Contract. Specific state procurement requirements regarding this type of contract were not met by the applicant. The district acknowledged this when you asked to remove the costs associated with the cabling from the FRN because of the public works issue. FCC rules require that applicants comply with all state and local competitive bidding rules. Because the district did not fully comply with all state competitive bidding requirements for the products and services requested in the FRN, you have not complied with FCC rules, and funding is denied.
