FCDL Comment:
MR1: The FRN was modified from CED 09/30/2011 to CED 06/30/2011 to agree with the applicant documentation. <><><><><> DR1: FCC rules require applicants to carefully consider all bids and choose the most cost effective solution. Documentation demonstrates that the applicant did not consider any bids. Applicant stated that per the laws in the state of Florida competitive bidding is not authorized, therefore, no bids were solicited. Furthermore, applicant stated that negotiations occurred with a single firm and that they did not conduct a competitive bidding process. Program rules and requirements provide that the applicant must be ready to accept bids once the FCC Form 470 is posted. Since the applicant did not accept competitive bids, they did not follow the program rules governing open and fair competitive bidding. Therefore, funding is denied. <><><><><> DR2: 30% or more of this FRN includes a request for Design and Engineering that is not coincident with the installation of eligible equipment and not part of a contract or bid for those eligible products or services; which is an ineligible service based on program rules.
